Will Poshmark Ban or Suspend My Account For Using a Bot?
You may have seen it disputed on message boards, YouTube, or on social media. Poshmark will ban or suspend your account for using a bot or software to aid in selling on the platform.
There is partial truth behind this. To gain an understanding, one would need to dive into the Terms of Service (TOS) for Poshmark. In the TOS, it clearly states the following:
Dated August 14, 2019
“Termination
You agree that Poshmark, in its sole discretion, may suspend or terminate your account (or any part thereof) or use of the Service and remove and discard any items or content within the Service, for any reason, including, without limitation, for lack of use or if Poshmark believes that you have violated or acted inconsistently with the letter or spirit of these Terms. Any suspected fraudulent, abusive or illegal activity that may be grounds for termination of your use of Service, may be referred to appropriate law enforcement authorities. Poshmark may also in its sole discretion and at any time discontinue providing the Service, or any part thereof, with or without notice. You agree that any termination of your access to the Service under any provision of these Terms may be effected without prior notice, and acknowledge and agree that Poshmark may immediately deactivate or delete your account and all related information and files in your account and/or bar any further access to such files or the Service. Further, you agree that Poshmark shall not be liable to you or any third-party for any termination of your access to the Service.”
When creating your posh account, you agreed that posh could ban your account FOR ANY REASON THEY DETERMINE OR FEEL LIKE.
Do you use Stock Photos?
The same individuals who claim accounts will become banned are using STOCK PHOTOS. Pulling photos from brand websites, retailers, and other users listings is considered copyright infringement. Using photos from the website of Nike, Lululemon, Free People. Etc is against the LAW! For those who sell on other platforms such as eBay. Name brands monitor and will report users to the platform and have their listings removed for this exact reason. Currently, this has not occurred on the Poshmark platform at this time but is not to say brands will not approach Poshmark claiming intellectual property on those images. In which case, Poshmark’s TOS indicates:
Conditions of Use
User Conduct: You are solely responsible for all descriptions, pictures of items, listings, information, data, text, software, music, sound, graphics, video, messages or other materials (“content”) that you upload, post, publish or display (hereinafter, “post”) or otherwise transmit via the Service, and for all items that you sell or purchase via the Service. The following are examples of the kind of items, content and/or use that is illegal or prohibited by Poshmark. Poshmark reserves the right to investigate and take appropriate legal action against anyone who, in Poshmark’s sole discretion, violates this provision, including without limitation, removing the offending items or content from the Service, suspending or terminating the account of such violators and reporting you to the law enforcement authorities.
OR
- violate any applicable local, state, national or international law, or any regulations having the force of law.
You will be held responsible in those cases if brands choose to pursue and prosecute Poshmark on copyright law. Long story short Poshmark is in current violation of U.S. Copyright Law.
The Use of Photos which are not yours is Copyright.
The Use of Logos which are Trademarked is not only against the TOS, It against the LAW.
Why Your Account WILL NOT BECOME BANNED!
There are Larger influencers, and virtual assistants who have made statements in regards to possible account banning Love receiving your follows and likes. Those same influencers will never tell you they indeed use software to give them a competitive advantage! Those making such statements are attempting to limit the number of posh sellers using such software to provide themselves with the Level up over you! There are roughly 5 million sellers on Poshmark those who can Share More, Sell More! It’s just that!
The more your selling, the more Poshmark is earning. Poshmark is a Business its goal is to generate Revenue. The last thing Poshmark would do is turn away a high earning top-rated seller who is generating profits for their company.
Share responsible and in a humanly way and you have nothing to fear.

What will have your account Banned?
- Scamming
- Attempting to make transactions outside of Poshmark
- Harvesting or attempting to collect users email or contact information
- Harassment towards other users.
- Selling counterfeit items
- A high number of order cancelations
- A high number of late shipments.
Even in the cases above, Poshmark typically will issue a letter of Warning before placing a total ban.
Poshmark is in business for Profits!
At the End of the Day
At the end of the day, it’s up to you to decide whether using Closet Assistant is unethical or a fit into your business model.
